This Privacy Policy explains how McCarthy & Associates, PLLC (“McCarthy & Associates,” “the firm,” “we,” “us”) collects, uses, and protects information you provide through this website, through our advertising lead forms (including Meta/Facebook and Instagram lead forms), by phone, and by text message. By submitting your information to us, you agree to the practices described below.
Information we collect
- Information you give us. When you fill out a form on this site, submit a Meta lead form, call, email, or text us, we collect the information you choose to provide, typically your name, mobile phone number, email address, the type of accident or matter, and any description of your situation.
- Text messaging consent. When you opt in to receive text messages, we record your mobile number and the date, time, and source of your consent.
- Technical information. Our web host and any analytics or call-tracking services we use may record standard technical information such as IP address, browser type, referring page, and pages visited.
How we use your information
We use your information only to respond to your inquiry, evaluate your potential claim, run a conflicts check, schedule a consultation, send the transactional text messages you requested, provide legal services if we are engaged, and operate and improve this website. We do not sell your personal information.
No mobile information will be shared with third parties or affiliates for marketing or promotional purposes. Text messaging originator opt-in data and consent will not be shared with, sold to, or rented to any third party. Information may be shared only with service providers that help us deliver our messaging (for example, our text-messaging platform), and only to the extent needed to provide that service. We do not purchase leads, and we do not share leads with third parties.

Who we share information with
We share information only with service providers that support the firm’s operations, such as case-management, hosting, email, messaging, and call-answering vendors, each of which is expected to protect it and use it only to provide services to us. We may also disclose information when required by law, subpoena, or court order, or when necessary to establish or defend a legal claim. Except as described in this policy, we do not share your information with third parties.
Mobile opt-in, SMS consent, and phone numbers collected for SMS communication purposes will not be shared with any third party or affiliates for marketing purposes.
Confidentiality
Contacting us does not by itself create an attorney–client relationship, and information you send before a written engagement agreement is signed may not be protected by the attorney–client privilege. Once the firm is engaged, client information is treated as confidential in accordance with the Texas Disciplinary Rules of Professional Conduct.
Retention and security
We keep inquiry information for as long as needed to respond to it and to meet the firm’s professional and legal obligations. We use reasonable administrative and technical safeguards to protect it, but no method of transmission over the internet or by text message is completely secure.
Your choices
To ask what information we hold about you, correct it, or request that it be deleted, contact us at info@mccarthylaw.com or (713) 300-8304. Some information must be kept where the firm has a legal or professional obligation to retain it.
Children
This site and our messaging program are not directed to children under 13, and we do not knowingly collect their information.
Changes to this policy
We may update this Privacy Policy from time to time. Changes take effect when posted on this page.
