Legal notices

Advertising disclosure, terms of use, and how we handle information submitted through this website.

Attorney advertising

This website is an advertisement for legal services. It is published by McCarthy & Associates, PLLC. The attorney responsible for the content of this site is Jeff McCarthy. The firm’s principal office is located at 602 Sawyer St, Suite 201, Houston, Texas 77007.

Unless otherwise indicated, attorneys listed on this site are licensed to practice law in the State of Texas and are not certified by the Texas Board of Legal Specialization in any area of practice.

No legal advice

The information on this website is provided for general informational purposes only. It is not legal advice and should not be relied upon as legal advice. Law changes, and the application of law to any particular set of facts requires an individualized analysis. You should consult a licensed attorney about your specific situation before taking or refraining from any action.

No attorney–client relationship

Viewing this website, sending an email, submitting a form, or calling the firm does not create an attorney–client relationship between you and McCarthy & Associates, PLLC. An attorney–client relationship is created only when the firm and the client execute a written engagement agreement.

Please do not send confidential or time-sensitive information through this website until an attorney–client relationship has been established in writing. Information sent before that point may not be treated as confidential and may not be protected by the attorney–client privilege. The firm may already represent an adverse party, which could prevent it from accepting your matter.

Prior results

Any reference on this site to past case results, verdicts, settlements, recoveries, client testimonials or endorsements does not guarantee, warrant or predict the outcome of any other matter. Every case is different. The outcome of any particular case depends on its own facts, the injuries involved, the applicable law, the venue, the clarity of liability and the insurance coverage or assets available to satisfy a judgment. Results described may reflect the combined experience of the firm’s attorneys, including work performed at prior firms, and figures may be stated before the deduction of attorney’s fees and case expenses.

Testimonials

Client testimonials appearing on this site reflect the experience of the individual client quoted. They are not a guarantee, warranty or prediction of the outcome of any other case, and they should not be construed as a statement about the quality of representation any other client will receive. Clients were not compensated for providing testimonials.

Fees and expenses

The firm handles most personal injury matters on a contingency fee basis, meaning that the firm’s attorney’s fee is a percentage of any amount recovered and no attorney’s fee is owed if there is no recovery. Contingency fee arrangements are set out in a written agreement signed before representation begins. The firm advances case expenses, and if there is no recovery the client owes the firm nothing — no attorney’s fees and no advanced case expenses. Clients may remain responsible for third-party obligations arising from their own matter, such as medical liens and subrogation claims. Nothing on this website modifies the terms of any executed engagement agreement.

Jurisdiction and unsolicited contact

This website is intended for residents of the State of Texas and for matters arising in Texas. Nothing on this site is intended as a solicitation for legal services in any jurisdiction where the firm’s attorneys are not licensed to practice. The firm may associate with or refer matters to lawyers in other jurisdictions where appropriate and permitted by the applicable rules of professional conduct.

Third-party links

This site may contain links to third-party websites. Those links are provided for convenience. The firm does not control, endorse or accept responsibility for the content, privacy practices or accuracy of any third-party site.

Intellectual property

The content, design, text, graphics and logos on this site are the property of McCarthy & Associates, PLLC or are used with permission, and are protected by applicable intellectual property law. They may not be reproduced or redistributed without written permission.

Privacy policy

What we collect. When you submit a form on this site, we collect the information you choose to provide — typically your name, phone number, email address, the type of matter, and any description of your situation that you include. Our web server and any analytics or call-tracking services we use may also record standard technical information such as IP address, browser type, referring page, and pages visited.

How we use it. We use this information solely to evaluate and respond to your inquiry, to run a conflicts check, to provide legal services if we are engaged, and to operate and improve the website. We do not sell your personal information.

Who we share it with. We may share information with service providers who support the firm’s operations, such as case management, hosting, email and call-answering vendors, each of which is expected to protect the information. We may also disclose information where required by law or court order, or where necessary to establish or defend a legal claim.

Confidentiality. Information you send before an attorney–client relationship exists may not be protected by the attorney–client privilege. Once the firm is engaged, client information is treated as confidential in accordance with the Texas Disciplinary Rules of Professional Conduct.

Text messages. If you provide a mobile number and consent to be contacted, the firm may contact you by text about your inquiry or matter. Message and data rates may apply. You can opt out at any time by replying STOP or by telling us directly.

Retention and security. We retain inquiry information for as long as necessary to respond to it and to meet the firm’s professional and legal obligations. We use reasonable administrative and technical safeguards, but no method of transmission over the internet is completely secure.

Your choices. To ask what information we hold about you, to correct it, or to request deletion, contact us at info@mccarthylaw.com or (713) 300-8304. Some information must be retained where the firm has a legal or professional obligation to keep it.

Children. This site is not directed to children under 13 and we do not knowingly collect their information.

Accessibility

The firm is committed to keeping this website usable by people with disabilities. If you encounter a barrier to using any part of this site, please contact us at info@mccarthylaw.com or (713) 300-8304 and we will work to provide the information you need in an accessible form.

Grievance information

The State Bar of Texas investigates and prosecutes professional misconduct committed by Texas attorneys. Although not every complaint against or dispute with a lawyer involves professional misconduct, the State Bar’s Office of the Chief Disciplinary Counsel will provide information about how to file a complaint. For more information, call the State Bar Grievance Information Helpline toll free at 1-800-932-1900.
